Непохоже на то. В целом, нахождение на территории США без визы не рассматривается как преступление:

Многие нелегалы свободно перемещаются по стране, работают, и, как я показал выше, правительство прилагало специальные усилия для того, чтобы задержать их здесь, остановив уже назначенные депортации, и уж конечно, не держало их в тюрьмах.
